Custody, Visitation and Quarantine

The phone calls and emails have started coming in to The Crosthwait Law Firm, with the questions all having a similar theme: What do we do about visitation now that school is cancelled?

In Oklahoma, schools started closing around the time Spring Break began, and custodial and non-custodial parents are wondering if the continued closures beyond Spring Break are a continuation of Spring Break, effectively extending the time of the parent who enjoyed custody/visitation through Spring Break to a future date uncertain.

The answer is no. According to the Oklahoma Supreme Court, in its Second Emergency Order Regarding the COVID-19 State of Disaster, issued on March 23, 2020, “[f]or purposes of determining a person’s right to custody and visitation/parenting time, the original published school schedule shall control in all instances. Custody and visitation/parenting time shall not be affected by the school’s closure that arise from the COVID-19 pandemic.”
